Macdonald & Cody, LLP (“Macdonald & Cody”, “us”, “we”, or “our”) operates the website macdonaldcody.com (“Website”) and provides various legal services to our clients, including providing legal representation in various specialties and a multitude of subspecialties (collectively, the “Services”). Through this privacy policy, we intend to be transparent about how your information may be collected, used and secured.

This Privacy Policy is meant to convey our online and offline data collection and use practices, in accordance with the California Consumer Protection Act (“CCPA”). However, there are differing interpretations of the CCPA and the final version of its implementing Regulations as published by the California Attorney General on August 14, 2020. Information Collection and Use

By providing your phone number, you agree to receive SMS from Macdonald & Cody, LLP. We will never share, trade, or otherwise sell your personal information such as Phone numbers and SMS consent to third parties under any circumstances.

This Usage Data may include information such as your computer’s Internet Protocol address (“IP address”), browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. Under certain circumstances, Usage Data may qualify as Personal Information.
Generic Information. Generic Information is information that does not directly reveal the identity of a Macdonald & Cody client or visitor to the Website. At times, we may require you to provide certain information, including Personal Information, in order to use certain parts of our Website, fulfill your requests with us, or provide you with certain Services. Business and Commercial Purposes for Collection. Macdonald & Cody collects, processes (or asks our business facilitation partners to process on our behalf), and uses your information to provide the Website, and Services. We therefore will collect and use your information for a variety of reasons, including:
- To perform a contract with you or provide those Services you have requested of us (for instance, we need to collect and process your information when you engage our Services in order to provide those Services to you).

How We Disclose or Share Your Information
Macdonald & Cody does not sell your information to any third party and will not share or sell your consent for SMS messages and phone numbers collected for SMS to any third parties under any circumstances. However, we may disclose your information to third-party service providers in order to provide our Services to you. For instance, if you provide information to us, we may securely store it in our document management system that is hosted by a third-party service provider. Similarly, if we have engaged third-party providers on your behalf, we may provide your information to them in order to provide the services for which they were engaged.

Please note that a “sale” of Personal Information does not include those instances when such information is part of a merger, acquisition, or other transaction involving all or part of our business. If we sell all or part of our business or make a sale or transfer of assets or are otherwise involved in a merger or other business transaction, we may transfer your Personal Information to a third party as part of that transaction. If such transaction materially affects the manner in which your Personal Information is processed, we will notify you of such change prior to its implementation.
Retention of Data
Macdonald & Cody will retain and use your Personal Information to the extent necessary to provide our Services and Website to you and our clients, comply with our legal obligations (for example, if we are required to retain your information in accordance with applicable laws), resolve disputes, and enforce our legal agreements and policies. We may, for example, be required to retain certain data for the purposes of tax reporting or responding to tax queries. California residents and data subjects in the EU / European Economic Area (“EEA”). Macdonald & Cody aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information and exercise other rights available under applicable law. We therefore inform you that, where applicable under relevant law, you are entitled to the following:
- Right to Access / Disclosure: to have access to your Personal Information upon simple request, that is, you may receive a copy of such data upon receipt of a verifiable request along with other information related to the processing that we may request from you.
- Disclosure of Direct Marketers: Macdonald & Cody does not provide any Personal Information to third parties for their own individual direct marketing purposes.
- Right to Information About Collecting, Selling, Sharing, or Disclosing Personal Information: upon receipt of a verifiable request, California residents may obtain a list of:
- The specific pieces of your Personal Information we hold;
- The categories of Personal Information collected about you, sold to third parties, or disclosed to third parties for business purposes;
- The categories of Personal Information sold within the last 12 months;
- The categories of sources from which Personal Information is collected;

Information collected from you by others, such as third-party websites that you access through links on the Website, are governed by those entities’ privacy policies. Children’s Privacy
Macdonald & Cody’s Website is intended for general audiences, and is not directed to anyone under the age of 13. If you are under 13, do not attempt to register for or use our Website and do not provide us any Personal Information about you. Macdonald & Cody does not intend to collect the Personal Information as defined under the Children’s Online Privacy Protection Act (“COPPA”) of anyone under 13 via this Website or any of our other online services in any way not allowed by COPPA.
If you are a parent or guardian and you are aware that we are in possession of your child’s Personal Information that was provided to us via our Website or other online services, please contact us. If we become aware that we have collected Personal Information from children via our Website or other online services without verification of parental consent, we will remove that information from our servers as soon as reasonably practicable.
Please note that, as part of the legal services we provide to our clients, we may collect information related to children under 18 via other means. Any such information will be collected in relation to our representation of our Clients and as permitted under relevant laws.
Changes to This Privacy Policy
Macdonald & Cody may update our Privacy Policy from time to time. While we reserve the right to make changes to our Privacy Policy at any time and at our sole discretion, we will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email or a prominent notice on our Website prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
Submitting a Verifiable Request to Macdonald & Cody
As mentioned above, California residents and EEA data subjects have certain rights to access, correct, delete, or otherwise control the use, collection, and/or disclosure of their information. Macdonald & Cody will respond to an individual’s “verifiable request” to exercise his or her rights under such laws, that is, where we have received a request claiming to be from a particular person, and we have been able to verify that person is who they say they are. The need to verify a person’s identity is critical to protecting your information, and ensuring that your information is not shared with anyone pretending to be you or someone who is not authorized to act on your behalf.
You may submit a verifiable request via our email address, mailing address, or telephone number listed in the “Contact Us” section below, or as otherwise provided on our Website. We will ask you to provide information about yourself so that we can verify your identity as part of this process. This information may include your name, address, and any other information deemed necessary by us to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you.
We may ask for additional information if we have difficulty confirming your identity. We will not share your information or honor other requests in those situations in which we are unable to confirm a request for your information is a “verifiable request.” We will not be able process your request if we cannot verify your identity.
Under California law a California resident can appoint an “authorized agent” to make certain verifiable requests upon their behalf, such as the right to know what information we collect about the consumer or to request deletion of the consumer’s information. An authorized agent may submit a request by following the steps outlined above. An authorized agent must identify the consumer he or she is submitting a request on behalf of, and provide the information requested by Macondald & Cody to verify the consumer’s identity. Macdonald & Cody will also require the purported authorized agent to submit proof that he or she has been authorized by the consumer to act on the consumer’s behalf.
Because the security and privacy of your information is paramount, we will ask that you identify and provide permission in writing for such persons to act as your authorized agent and exercise your applicable rights under California law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization. We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.
Please note that we will only process valid rights requests as they apply to California residents and EEA data subjects.
